These Terms of Service ("Terms") govern your access to and use of the PastIt mobile application and related services (collectively, the "App") provided by PastIt ("PastIt," "we," "us," or "our").
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
Eligibility
PastIt is intended for users at least 17 years old due to references to tobacco and nicotine use. By creating an account, you represent that you meet this age requirement in your jurisdiction.
Account Registration
You may create an account using Apple Sign In, Google Sign In, or email. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at **support@pastit.app** if you suspect unauthorized access.
App Description
PastIt is a non-medical, self-help application designed to support users in quitting nicotine products including cigarettes, heated tobacco (IQOS), vapes, e-cigarettes, nicotine pouches, cigars, and hookah. The App provides streak tracking, daily check-ins, health milestones, trigger logging, pattern insights, an AI coach, community features, and a 24-hour pledge system.
Not Medical Advice
The PastIt App is **not** a healthcare service, medical device, therapy platform, or treatment program. PastIt does **not** provide medical advice, diagnosis, or treatment. No doctor–patient or therapist–client relationship is created through the App.
Health milestones are based on publicly available data from WHO, CDC, and NHS and describe general population-level improvements. They may not reflect your individual outcomes.
The AI coach provides informational support based on cognitive behavioral therapy (CBT) principles. It is **not** a therapist, counselor, or medical professional. Its responses do not constitute medical or psychological advice.
If you are experiencing a medical or mental health emergency, contact your local emergency services immediately.
Subscriptions and Payments
PastIt offers paid subscription plans. By subscribing, you agree to pay the applicable fees displayed at the time of purchase.
**Billing:** Subscriptions are billed through the Apple App Store or Google Play Store. Payment is charged to your App Store or Play Store account at confirmation.
**Auto-renewal:** Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
**Cancellation:** You may cancel at any time through your App Store or Play Store subscription settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time within a billing period.
**Price changes:** We may change subscription pricing. Price changes take effect at the start of the next subscription period after notice. Continued use after a price change constitutes acceptance.
**Free access:** If a free tier is offered, it may be modified, limited, or removed at any time without prior notice.
Refunds
Refunds are handled by Apple or Google according to their respective refund policies. PastIt does not process refunds directly. To request a refund, contact Apple App Store Support or Google Play Support.
User Conduct
You agree not to:
- Use the App for any unlawful purpose
- Post content that is abusive, harassing, threatening, hateful, or discriminatory in community areas
- Impersonate another person or entity
- Attempt to access other users' accounts or data
- Interfere with or disrupt the App's functionality or servers
- Upload malicious code, viruses, or harmful content
- Use automated systems (bots, scrapers) to access the App
- Resell, redistribute, or commercially exploit the App or its content
We reserve the right to suspend or terminate accounts that violate these Terms.
Community Guidelines
Community features (posts, comments, leaderboard) are subject to the following:
- Be respectful and supportive of other users
- Do not share personally identifiable information about yourself or others
- Do not post medical advice or recommend specific treatments
- Do not promote nicotine products, tobacco, or substance use
- Do not post spam, advertisements, or promotional content
We may remove content or suspend accounts that violate these guidelines at our discretion without prior notice.
Intellectual Property
The App, including its design, code, content, branding, logos, health milestone data, and AI coach responses, is owned by PastIt and protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the App without our written permission.
You retain ownership of content you create within the App (journal entries, community posts, trigger logs). By posting content in community areas, you grant PastIt a non-exclusive, worldwide, royalty-free license to display that content within the App for the purpose of operating the community feature.
. AI Coach Disclaimer
The AI coach is powered by third-party artificial intelligence (Anthropic's Claude). Responses are generated algorithmically and may occasionally be inaccurate, incomplete, or inappropriate. PastIt does not guarantee the accuracy, reliability, or suitability of AI-generated responses.
Do not rely on the AI coach for medical, legal, financial, or emergency advice. Always consult qualified professionals for such matters.
Health Data Disclaimer
Health milestones, brain rewiring progress, and recovery timelines presented in the App are based on published research from WHO, CDC, and NHS. These represent general population-level data and statistical averages.
Individual results may vary significantly based on factors including duration of use, quantity consumed, type of nicotine product, overall health, genetics, and other lifestyle factors.
PastIt makes no guarantee that you will achieve any specific health outcome, quit successfully, or maintain abstinence from nicotine.
Limitation of Liability
To the maximum extent permitted by applicable law, PastIt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising from your use of or inability to use the App.
Our total liability for any claim arising from these Terms or the App shall not exceed the amount you paid to PastIt in the 12 months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
Indemnification
You agree to indemnify and hold harmless PastIt, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App, violation of these Terms, or infringement of any third party's rights.
Termination
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately.
You may terminate your account at any time by deleting it through Settings → Delete Account or by contacting **support@pastit.app**.
Provisions that by their nature should survive termination (including Limitation of Liability, Disclaimer of Warranties, Indemnification, and Governing Law) will survive.
Privacy
Your use of the App is also governed by our Privacy Policy, available at **pastit.app/privacy**. By using the App, you consent to the collection and use of information as described in the Privacy Policy.
Change To Terms
We may modify these Terms at any time. Material changes will be communicated through the App, by email, or by posting updated Terms. Continued use of the App after changes constitutes acceptance of the revised Terms.
If you do not agree to the revised Terms, you should stop using the App and delete your account.
Governing Law
These Terms are governed by the laws of the Hellenic Republic (Greece), without regard to conflict of law principles. Any disputes arising from these Terms or the App shall be resolved in the courts of Athens, Greece.
For users in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and PastIt regarding your use of the App and supersede any prior agreements.
